Preparing Your Estate? 2 Tips To Get You Started

Law Blog

Estate planning can be difficult if you do not know what you are doing. It is important, however, as you do not want your valuables and precious things to get into the wrong hands. If you have nothing in place a judge will determine who gets your items, land, etc. Estate planning will prevent all this from happening as you arrange where you want your assets to go while you are still alive. Below are two tips on estate planning so you can feel rest assured everything is taken care of.

Set Up a Will

A will is very important as it will help prevent arguments from family members after your death. The will states where you want everything to go and your family members must abide by your wishes. If one of your family members do not agree, however, they can contest the will. This is an expensive and time-consuming process. You can help prevent this from happening by ensuring the will is prepared correctly and that you sign the will when you have good mental capabilities. For example, if you have a type of disease that affects you mentally, such as dementia, the will can be contested much easier.

On the will you will state where all your assets go. If there are minor children involved, you can state who controls the money until the children reach a certain age. If you have minor children, you need to choose who will be the guardian over your children until they reach adulthood. This must be clearly stated in the will. Choose someone to be the executor to handle everything in case you become incapacitated.

Use Insurance to Offset Taxes

Your loved ones will have to pay taxes on the assets they receive. The amount of taxes can be significant if your estate is worth a lot of money. To help with this you can set up a life insurance plan to cover the taxes. For example, if an estate planner determines your beneficiary will have to pay $300,000 in income and estate taxes, you should purchase life insurance that will cover this amount. You do have to name the individual getting the assets as the beneficiary of the life insurance plan, however.

The money your beneficiary receives from the life insurance company after your death is tax free. This means your beneficiary can use all the money they receive to pay off taxes.

Contact an estate attorney, like Christena Silvey Coleman CSC Law, LLC, to help you with this. This will ensure everything is done correctly.
